EULA
End-User License Agreement
This End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and the mentioned author (Birdline) of this Software for the software products identified as one of: Birdline Skin Editor, Birdline Black and White Suite, Birdline Classic Suite, Birdline Dark Blue Suite, Birdline Flexi Suite, Birdline Elegant Suite, Birdline Default Suite, Birdline Light Green Suite, Birdline Platinum Pack, Birdline Mixer Lab, Birdline Skins Lab, which includes computer software and may include associated media, printed materials, and “online” or electronic documentation (“SOFTWARE PRODUCT”).
By downloading, installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bounded by the terms of this EULA.
If you do not agree to the terms of this EULA, do not create an account, do not download, install or use the SOFTWARE PRODUCT.
SOFTWARE PRODUCT LICENSE
The SOFTWARE PRODUCT, is being distributed as downloadable Licensed Software for personal or commercial use.
GRANT OF LICENSE
This EULA grants you a revocable, nonexclusive, nontransferable, limited license to download, install and use the SOFTWARE PRODUCT solely for your personal or commercial use, strictly in accordance with the terms of this Agreement.
DOWNLOAD
You must create an account at the author’s web site, and register any unique License Key of the SOFTWARE PRODUCT that you own.
You may download only one copy of the main version and only one copy of each sub versions of the SOFTWARE PRODUCT that is registered in your account.
For more downloads, you may contact the author for permission.
INSTALLATION AND USE
You may install and use the SOFTWARE PRODUCT to any computer that you own.
REPRODUCTION AND DISTRIBUTION
You may NOT license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the SOFTWARE PRODUCT or make the SOFTWARE PRODUCT available to any third party.
DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
Limitations on Reverse Engineering, Decompilation, Disassembly and change (add, delete or modify) the resources in the compiled assembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT.
UPDATE AND MAINTENANCE
Updates and Maintenance will be provided by the author as needed.
Any sub version updates will be free.
SEPARATION OF COMPONENTS
The SOFTWARE PRODUCT is licensed as a single product. Its component parts may not be separated for use on any computer.
SOFTWARE TRANFER
A written permission by the author is needed to permanently transfer all of your rights under this EULA, provided the recipient agrees to the terms of this EULA.
TERMINATION
Without prejudice to any other rights, the Author of this Software may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, your account will be disabled, and you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
COPYRIGHT.
All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, clipart, libraries, and examples incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by the Author of this Software. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material.
LIMITED WARRANTY
The Author of this Software, warrants that the SOFTWARE PRODUCT will provide the features and functions generally described in the product specification on its website when you purchased it and in the product documentation. Media on which the Software is furnished, if any, will be free from defects in materials and workmanship.
NO LIABILITY FOR DAMAGES.
In no event shall the author of this Software be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the Author of this Software is aware of the possibility of such damages and known defects.
